Conditions of Use of the Site
1. Scope of application
These Conditions of Use (the “Conditions”) govern access to and use of this website (the “Site”), operated by Fornett S.a.s. (“Fornett”).
By accessing or browsing the Site, you accept these Conditions in full. If you do not agree to any part of them, you must discontinue use of the Site immediately.
The Conditions form part of the overall legal framework applicable to the Site, including Fornett’s General Terms of Sale where relevant. If a conflict arises between these Conditions and the General Terms of Sale, the latter shall apply to transactions involving the purchase of products. Where no purchase is made, only these Conditions apply.
Fornett may amend or update these Conditions at any time. Changes take effect once published on the Site. Continued use of the Site following publication constitutes acceptance of the revised Conditions. Users who do not accept the updated Conditions must stop using the Site and close any existing accounts.
2. Nature and use of the Site
The Site is an informational platform through which Fornett presents its materials, products, projects and related activities.
The Site does not function as an e-commerce channel and no online sales are offered.
Certain areas or functions of the Site may be accessible only to individuals or companies who submit an inquiry or request samples and are provided with specific credentials in order to complete that process.
3. Intellectual and industrial property
The Site and all material available on it (“Content”) are the property of Fornett, its affiliates or licensors. The Content includes, among other elements, trademarks, product images, drawings, documents, photographs, layouts, software, texts and any other material accessible through the Site.
All such material is protected by copyright and industrial property legislation. Except where expressly permitted in these Conditions or specifically authorised in writing by Fornett, the Content may not be copied, reproduced, modified, distributed, published or used for any purpose.
4. Use of product images and technical drawings
Users may view and download images and technical drawings appearing on the Site solely for personal, non-commercial reference, provided that the material remains intact and that all credits, authorship references and Fornett trademarks remain clearly visible.
Where Fornett has granted prior written authorisation, architects, designers, approved partners or distributors may make use of such material only in the context of presenting or promoting Fornett products to identified end clients in relation to a specific project. Any use falling outside this narrowly defined purpose is not permitted.
5. Site features and availability
The Site and its Content are provided in the state in which they are published. Fornett gives no warranty, whether explicit or implied, regarding accuracy, continuity of service, security, absence of harmful software or suitability of the Site for particular purposes.
Use of the Site occurs at the user’s own risk.
6. Credentials for sample requests
The Site does not require the creation of a general user account.
Credentials are required only when an individual or company submits a request for sample materials, including but not limited to Fornett’s sample boxes.
Upon submission, the user receives an automatic confirmation indicating that the request has been received and is under review. The confirmation does not constitute acceptance of the request. Fornett evaluates each inquiry at its sole discretion.
Fornett reserves the right, at any time and without obligation to provide justification, to accept, limit, postpone or refuse any request for samples.
If the request is accepted, the samples will be prepared and dispatched by courier to the delivery address indicated in the form. The user is responsible for ensuring that all information supplied is accurate, complete and up to date. Fornett shall not be liable for delays, impossibility of delivery or other issues arising from incorrect or incomplete information.
Any suspicion of misuse of the form, provision of false or misleading information or unauthorised use of another person’s data authorises Fornett to suspend, cancel or refuse the request. The user must promptly inform Fornett if they believe that the information submitted has been misused or accessed unlawfully.
If the inquirer submits the request on behalf of a company, the inquirer represents and warrants that the request is placed with the knowledge and authorisation of that company, and that the inquirer has the necessary powers to bind or validly represent that company for the purpose of obtaining samples. Fornett may request further confirmation of such authority at any time.
7. Improper or unlawful use
Users must comply with applicable law and these Conditions when accessing the Site. They must not use the Site to disrupt its technical functioning, harm its infrastructure, engage in unlawful or deceptive conduct, infringe intellectual property rights belonging to Fornett or third parties, or cause disturbance to others.
Fornett may restrict or block access to the Site or to functionalities connected with Credentials if it considers that the user has breached these Conditions. Users are responsible for any damage they cause to Fornett or third parties through improper use of the Site.
8. Personal data and cookies
Personal data collected through the Site is processed in accordance with applicable legislation, as described in the Privacy Policy available on the Site.
Cookies are used according to the Cookie Policy published on the Site.
9. Links to external sites
The Site may contain links to external websites or applications managed by third parties. Fornett does not control such external resources and is not responsible for their operation, content or availability.
Links do not imply approval or endorsement by Fornett.
Users may link or share pages of the Site only for personal and non-commercial purposes, and must not do so in a way that misrepresents or exploits Fornett’s brand or Content.
10. Limitation of liability
Fornett is not liable for interruptions, malfunctions, inaccuracies or delays arising from technical issues, incorrect or incomplete information provided by users, external factors or improper use of the Site.
Use of the Site is entirely at the user’s risk.
11. Applicable law and jurisdiction
Unless mandatory rules provide otherwise, these Conditions are governed by Italian law.
Any dispute concerning use of the Site or the interpretation of these Conditions falls under the exclusive jurisdiction of the courts of Milan, Italy.
12. Language
Translations of these Conditions are provided for convenience. In the event of inconsistency, the Italian version prevails.
